Terms & Conditions

These terms and conditions (“Terms”) govern your access to and use of the websites operated by Habitat GPBC (“we”, “our”, “us”, “Habitat”). By accessing or using our site, you agree to comply with and be bound by these Terms.

1. Acceptance of Terms

By accessing our website at habitatgreaterpbc.org and any sub-pages, you acknowledge that you have read, understood and agree to these Terms. If you do not agree, please do not access or use the site.

2. Use of the Website

You agree to use the website for lawful purposes only, and only in a way that does not infringe the rights of, or restrict or inhibit the use and enjoyment by others. You must not misuse the site (including, but not limited to, hacking, introducing viruses or other harmful material).

3. Donations, Payments & Refunds

  • All online donations, event payments or purchases processed through our site or affiliated platforms are subject to the donation/payment terms specific to that activity.
  • Your donation is non-refundable unless required by law or otherwise specified in the donation terms.
  • We reserve the right to refuse or cancel a donation transaction if it is deemed fraudulent, for example.
  • If you register for an event requiring payment and subsequently withdraw, refund eligibility will be determined by the event’s terms as posted at time of registration.

4. Volunteer Activities

  • Volunteers engaging in build days, ReStore work or other activities must follow all guidelines, safety rules and waivers provided by Habitat GPBC.
  • Participation is at your own risk; you consent to assume the risks associated with construction, donation pickup or other volunteer operations. 

5. Homeownership Program Participation

  • Applicants for our homeownership program must meet the eligibility criteria, complete required “partnership hours,” attend training and enter a 30-year agreement as outlined in our program documentation (see application instructions).
  • Failure to comply with program terms may result in disqualification or termination of the agreement. 

6. Intellectual Property

  • All content on the website (text, graphics, images, logos, icons, etc.) is owned by or licensed to Habitat GPBC and is protected by U.S. and international copyright and trademark laws. You may view, download or print pages for your private, noncommercial use only, provided you keep all copyright and proprietary notices intact. Any other use (modification, reproduction, distribution) is strictly prohibited without our prior written consent.

7. Disclaimers & Limitation of Liability

  • The website and its content are provided on an “as-is” basis. We make no warranties of any kind, express or implied, regarding the completeness, accuracy, reliability or suitability of the information.
  • In no event shall Habitat GPBC or its directors, officers, staff, volunteers or affiliates be liable for any direct, indirect, special, incidental or consequential damages arising from the use of or inability to use the website or participation in any program, even if advised of the possibility of such damages.
  • Some jurisdictions do not allow the exclusion of liability for certain types of damages, so some of the above limitations may not apply to you. 

8. Indemnification

You agree to indemnify and hold harmless Habitat GPBC, its directors, officers, employees, volunteers and agents, from and against any claims, losses, liabilities, damages, costs or expenses (including legal fees) arising out of your misuse of the website or breach of these Terms.

9. Privacy & Data Use

Your use of the website is also governed by our Privacy Policy, which explains how we collect, use and protect your personal information. By using the website you accept the practices described in the Privacy Policy. 

10. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted on this page with a revised “Last updated” date. You should check this page regularly. Your continued use of the site after modifications constitutes acceptance of the new Terms.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Florida, U.S.A. Any dispute arising out of or relating to these Terms or your use of the site will be subject to the exclusive jurisdiction of the state or federal courts located in Palm Beach County, Florida.
